Mr. Clatterbuck asked if there were any comments on the minutes from October 19, 2000 meeting.

Mr. Napier made a motion to approve the minutes of October 19, 2000 as submitted.

Mr. Day seconded the motion.

The vote was: Mr. Clatterbuck-yes, Mr. Napier-yes, Mr. Day-yes, Mr. Winkhart-yes and Mr. Bauder-yes.

AMENDMENT #492-00 – Larry Kolic of 4179 Georgia St. NW, Massillon, Ohio 44646 agent for Dennis & Barbara MulQueen, property owner, of 6668 Knightbridge NW, Canton, Ohio 44718 propose to rezone R-2 (Two Family Residential District) to R-1 (Single-Family Low Density Residential District) 5.42 acres, more or less, on the east side of Harris Ave., 400 ft., more or less, north of LynLeigh Circle, Sect. 34NE Jackson Twp. Mr. Clatterbuck read the file application and the Stark County Regional Planning recommendation for approval and the facts that were considered in their decision.

Mr. Clatterbuck asked who would like to speak in favor of this amendment.

No one came forward.

Ms. Poindexter explained that she had not received the green certified card stating that the applicant had received his notice but did received the certified card back from the property owner.

Mr. Clatterbuck asked if anyone wanted to speak against the proposed zone change.

Mr. Julian of 6525 LynLeigh Circle NW, Canton, Ohio 44708 stated that is not against the amendment but had a few questions.

Mr. Julian asked if duplexes are permitted in an R-2 district and if where he lives on LynLeigh is R-2 or R-1.

Mr. Clatterbuck stated Mr. Julian’s property is zoned R-1 single family.

Mr. Julian asked if condos are permitted in an R-1 district.

Mr. Clatterbuck stated that a planned residential development is what is shown in the file.

Mr. Phillippi stated there could be a condo development but only single family detached dwellings are permitted.

Mr. Julian asked if this could be done under the R-2.

Mr. Phillippi stated in an R-2 there could be single or two family dwellings. Mr. Phillippi stated what is requested would not allow two family dwellings.

Mr. Julian asked why the applicant is asking for a zone change if he can do it anyway.

Mr. Winkhart stated because they are proposing a PRD.

Mr. Clatterbuck stated a PRD could not be done under the present zoning.

Mr. Julian asked what they would do with Groton.

Mr. Clatterbuck stated that normally this is a county requirement. It is his guess that the road would run through.

Mr. Julian and the board had no further questions or comments.

Mr. Napier made a motion to vote on amendment 492-00 as submitted.

Mr. Bauder seconded the motion.

The vote was: Mr. Clatterbuck-yes, Mr. Napier-yes, Mr. Day-yes, Mr. Winkhart-yes and Mr. Bauder-yes.

Mr. Clatterbuck stated that the board has voted in favor of the proposed zone change and it is just a recommendation that goes to the trustees.

Ms. Poindexter stated that the trustees have already set a date to hear the amendment. It is set for January 8, 2001 at 7:30 pm.

Mr. Clatterbuck stated if anyone is interested they could attend the trustee meeting on January 8, 2001 at 7:30 pm. This is when the trustees would hear the amendment.

AMENDMENT 493-00 – Regal Construction Co. of 7239 Wales Ave. NW, North Canton, Ohio 44720 agent for Windamear Properties Inc., property owner, of 7239 Wales Ave. NW, North Canton, Ohio 44720 proposes to rezone B-3 (Commercial Business District) to R-R (Rural Residential District) .617 acres, more or less, east of Mears Gate Dr. and west of Wales Ave. and R-2 (Two Family Residential District) to R-R (Rural Residential District) .100 acres, more or less, on the east side of Mears Gate Dr. 500 ft., more or less west of Wales Ave. and B-3 (Commercial Business District) to R-2 (Two Family Residential District) .043 acres, more or less, on the northwest corner of Harvey and Mears Gate Dr. and R-R (Rural Residential District) to R-2 (Two Family Residential District) .269 acres, more or less, 250 ft., more or less, west of Harvey and South of Feildmont St., Section 9SE Jackson Twp. Mr. Clatterbuck read the file application and the decision of the Stark County Regional Planning Commission for approval and facts that were considered in their decision.

Mr. Clatterbuck asked who would like to speak in favor of the proposed zone changes.

Mr. Bob Leach, president of Regal Construction Co. of 7239 Wales Ave. NW stated that he views the zone changes as an administrative change so they are not looking to change the use of any of the parcels. There is a strip of property along Wales Ave. that was zoned B-3 in 1960. Parcel #1 is a section that is owned of the 500-ft. strip. It is in the rear away from Wales Ave. and will be the back of the lots that are being developed. Mr. Leach stated he does not know what could be done with a 60-ft. strip zoned commercial.

Mr. Leach stated there is a section about 10 ft. that is zoned R-R in an R-2 district and the 4/100 of an acre that is zoned B-3 and a strip that is zoned R-2 that doesn’t work.

Mr. Leach stated the changes amount to about one acre if totaled. Mr. Leach believes the changes are administrative.

Mr. Leach stated that they are not gaining any lots.

Mr. Leach had nothing further to add.

No one else in the audience spoke in favor of this amendment and no one spoke against this amendment.

Mr. Clatterbuck stated that he agrees with Mr. Leach that it is just cleaning up the land.

Mr. Phillippi stated actually it is an administrator measure and with regards to the proposed PRD, it is a requirement that was placed on the final approval so the entire area of the PRD is within the R-R zone.

There were no further comments.

Mr. Napier made a motion to vote on amendment 493-00 as submitted.

Mr. Winkhart seconded the motion.

The vote was: Mr. Clatterbuck-yes, Mr. Napier-yes, Mr. Day-yes, Mr. Winkhart-yes and Mr. Bauder-yes.

Mr. Clatterbuck stated the board has recommended approval for the zone change and this is only a recommendation that goes to the trustees. The trustees have set the meeting date for January 8, 2001 at 7:45 pm.

Mr. Napier made a motion to adjourn.

Mr. Winkhart seconded the motion.
