DESTRUCTION OF WEEDS

ENFORCEMENT POLICY

 

PURPOSE:   To control the spread of noxious weeds, wild parsnip, wild carrot, oxeye daisy, wild mustard, or other harmful weeds growing on lands in Jackson Township.

 

NOXIOUS WEEDS:  Means shatter cane (Sorghum bicolor), Russian Thistle (Salsola kali var. tenuifolia), or any plant designated a noxious weed by the director of agriculture.

 

ENFORCEMENT PROCEDURE:

 

  1. The Board of Trustees receives written information that noxious weeds or other harmful weeds are growing on lands in Jackson Township and forwards same to Zoning Department for processing.
  2. An acknowledgement letter is sent to the complainant signed by the Zoning Inspector.
  3. The complaint is forwarded to the Zoning Investigator for inspection and report.
  4. If noxious weeds are found by the Zoning Investigator, a resolution is adopted by the Board of Trustees and sent by certified mail notifying the person in charge of the land to destroy the weeds within five days of receipt of the resolution.
  5. If the person in charge of the land fails to comply with the resolution, the Board of Trustees shall cause the weeds to be cut or destroyed and may employ the necessary labor, materials, and equipment to perform that task.
  6. The Board of Trustees shall make a written report to the County Auditor of the Board’s action with a statement of the Board’s charges for its services, the amount paid for the labor, materials, and equipment, and a proper description of the premises.  These amounts, when allowed, shall be entered upon the tax supplicate, shall be a lien upon the land from the date of the entry, and shall be collected as other taxes and returned to the Township and placed in the Township General Fund.

APPLICABILITY

This Policy shall be applicable for any lot in a platted subdivision and other places of less than one acre in size.

EFFECTIVENESS

            This Policy shall be in effect each year from May 1 through September 30.
