Pizzino called the special meeting to order at 5:00 p.m. at the Jackson Township Hall with all Trustees, Fiscal Officer, Lyon, Fitzgerald and Neftzer present. He requested that all cell phones and pagers be turned off at this time.
The Pledge of Allegiance was recited.
Pizzino moved and Meeks seconded a motion to go into Executive Session for Police Department Personnel (Appointment/Employment/Compensation).
At 5:52 p.m., Pizzino called the General Session to order.
Pizzino: At this time, I’d like to call on the Administrator, Marilyn, to talk about salary comparisons and benefits.
Lyon: Thank you. What I did was look at the Patrol and Sergeant’s Union Contracts and compared it with the Class B Benefits of the Management Package and there are a few differences. This position will be a Class B Management and is exempt from overtime except for comp time that can be accumulated hour for hour up to forty hours, similar to the Department Heads. There is an increased vacation benefit which is five weeks after ten years, the Union Contract had five weeks after fifteen years, and six weeks after twenty years is Class B. The longevity is the same. The uniform allowance is $550 a year for the Management Package as opposed to $1,000 for the patrol and sergeants. There is an additional personal day as a manager. There are three days total as opposed to two for the unions.
Pizzino: Okay, our last Major, he had a Township vehicle for Township use. I’m assuming that’s on here also.
Lyon: Correct.
Pizzino: Okay. Any other discussions about the benefit comparisons? Any comments? Let’s get into the salary for the position of Major.
Lyon: What I did was compare other agencies for their second in command. There are other Townships and Cities listed and their average salary was $68,844 for that similar position. Our lieutenants, right now, the base salary is $66,839 and for this position, to have a differential between the lieutenant and the major, it’s recommended that we look at a salary of $69,500, which is about a 4% difference between the lieutenants and the major position.
Pizzino: It’s recommended by the Administrator that we set the salary for this position at $69,500. Does any Board member have any comments about this? Seeing none, okay anything else, Mrs. Lyon?
Lyon: No.
Pizzino: Chief Neftzer, I know this has been a long and difficult challenge for you to pick one of these three gentlemen. It wasn’t an easy pick, as we’ve all talked about. You want to give us your recommendation at this time?
Neftzer: Yes, sir. The first thing I want to do is acknowledge the three individuals here as well as the other guys that put in for the position. They’ve had some sleepless nights as well but it’s because they’re invested in this community and this Police Department and they only want what’s best for our residents. So without further ado, I know these guys have been waiting on this all week, but it’s going to be my recommendation that Dave Zink be promoted to the position of Major.
Pizzino: We have a recommendation from our Chief of Police for David Zink to be the next Major of the Jackson Township Police Department District. Do we have a resolution?
Meeks: Do we have an effective date?
Neftzer: October 28, if we could, which is Saturday.
RESOLUTION 06-100, ATTACHED
Meeks moved and Burger seconded a motion
pursuant to ORC Section 505.49, we hereby appoint David Zink as full time
Police Department Major for the Jackson Township Police District Department,
Stark County, Ohio, effective October 20, 2006, with compensation of $69,500
per year and the benefits of a Class B employee as described in the Management
Personnel Benefit Package (except the overtime provisions in Article III
and compensatory time in Article IV shall be earned at straight time) contingent
upon the completion of a 365 day probationary period and we accept the
attached oath of office.
Be it further resolved that, pursuant to 29 USC 207(a)(1), the Police Department Major position is an executive and administrative position exempt from the overtime payment provisions of the Federal Fair Labor Standards Act.
Be it further resolved that, except in cases that involve major rule/regulation violations, should David Zink be removed from the position of Police Department Major or the position is eliminated, David Zink will be returned to his former position of Patrol Officer.
At 6:19 p.m., Pizzino called the meeting to order.
Pizzino swore in David Zink to the position of Major of the Jackson Township Police District Department, Jackson Township, Stark County, Ohio.
